Barracks search and seaizure Rules, Regs, UCMJ?


We recently had a new company form, for our student (IET) soldiers, as such the new 1SG went through and did room inspections. I'm permanent part and my room was not inspected. However a friend of mine, also remnant party, had his room not just inspected but searched or tossed as he said.

It was messy, but they searched his room and found medical supplies as well as RX medications, some of which where his, but had no labels.

Their trying to get him in trouble for the medical supplies and drugs..

But was their search even legal? keep in mind he wasn't here when they started only called in after they found stuff.

Now we're both medics and I'm afraid I could be in the same situation as him if they search my room, I also have 2 aid bags stocked with supplies, including some RX medications.

What is the rule, regulation or section of the UCMJ that covers search and seizure?

Also are their any rules that cover medics? Some of the meds are given to us by the Army.

The inspection as far as I've seen was for the IET soldiers only, and it was only a inspection.

Hey is permanent party and his room was tossed, so I wouldn't consider it part of the 'mass' inspection, seeing that was only conducted on IET soldiers.

The Military owns the room. They can do what they want to the room. They do not have to tell you about it.

It is like when you rent an apartment the land lord can kick you out when ever he wants because its not your it his, you just live there.

If they believe he is or was selling drugs or doing something illegal they can inspect only his room.

1. You are occupying government quarters.
2. The Fourth Amendment to the Constitution does not apply in your case, specifically the requirement to obtain a search warrant. That only happens if it is a search upon the gear held by a certain individual and those investigating have credible information from a third party, sufficient to have a search warrant executed. Mass inspections of living spaces are not that sort of case.
3. If you are a medic and those aid bags and their contents were issued to you, then there should be no problem. Just make sure you have no Class V narcotics or drugs similar to that in those bags.
