Michigan People Only (single mothers or anyone who knows court laws)?

Im recently going through a divorce I have a ppo with my childrens father. hes been telling me he will get custody of my kids. Can he get custody of my kids? Im 23 go to school full time and on state aid is that bad?? Im scared hes gonna try to take them, I do everything for them he hasnt seen them is weeks before that he hasnt seen them for almost a year. He doesnt pay child support or when i ask him if i can have 20 dollars for diapers he flips. He says Im unfit cuz i live off state aid. Im only on state aid cuz he left me with them two and no job no place to live. I dont drink or do drugs either. Help please some advice.

Most states divorce are the same nowadays where kids are involved. Unless he can prove beyond a reasonable doubt child or drug abuse, you will get the kids, the house, child and probably spousal support. Hes probably trying to scare you into agreeing to something before court. What youve stated is not constituted as a unfit or dangerous mother so dont worry. He has to have concrete evidence proving you as such, like police reports or medical reports. His tactics willwork against him so sign nothing involving your kids, custody,or support. Sue him for everything that you are legally entitled to. Its impressive to see you trying to better yourself and for your kids, but dont worry. Just tell him you will see him in court. Go to your county's Friend of Court office. I doubt he can get custody. Probably doesn't really want it, just yanking your chain. Next, Dept of Social services. Stay with the college. Things WILL get better.

Most states have similar laws, such as:
Primary caregiver - the person who is there when the children wake, gets them fed, meets there basic needs, and nurtures them.
Where the children have lived and with whom for the last 6 months. Courts don't like uprooting children if they do not have to.
And, what kind of relationship a parent has. i.e, little or no visitation doesn't bode well with most family court judges.

I wouldn't worry about it. State aid but going to school is not bad at all because it shows you are trying to better yourself and take care of your family both.
