Do you know anyone who has won a move-away case in California?

I am no longer able to afford to live in CA with my kids and my child support keeps getting lowered. I am being evicted this month and my parents are moving to another state where the cost of living is substantially lower. The problem is, we had an evaluation and it stated that it would be a detriment to move the kids but that they are to remain with me.

Since then, we came up with an agreement that we both signed keeping me here. I deeply regret signing it and now I can't fulfill it. I didn't have much of a decision because my attorney subbed out due to my inability to pay. I was afraid to go to trial without an attorney. Now, I am in that position but have this agreement keeping me here.

The judge asked me if I wanted a trial to prove the impossibility to perform the contract. I'm so afraid of losing custody because their dad is on drugs but I can't prove it. He lies doesn't get caught. I have no attorney to prove anything and have been denied by legal aid.

Or, you can do what I did. I was SUPPOSED to stay in the state of WYOMING. But, I left the state for the same reasons you want to. I did not get permission, I just did it. He never had the money nor did he take the time to get the court to make me come back. She's 19 now and I do not have to worry about it. Or you can just tell the court that your situation has changed and if he can not take care of those kids 50-50 you need to move where you can do it alone. be prepared to do it. Good luck. Your attorney cant "prove" anything anyways...The court it seems had already decided that the kids were best off with you....so all it seems you really need to do is prove you cant afford to live in CA which should not be very hard to do
