My fiance just got arrested for drug possession and possession with purpose to traffic. HELP?!?!?

He's going to going to legal aid in the morning, but I need to know sooner than that what his chances are. It was his friends, who was also in the car, and is still being held. He was let out, which is why I know what's going on. It was cocaine and I'm not sure how much of it... What's likely his minimum jail time/fine?

I'm just so worried.

Well you need to take everything that occured into detail. How much cocaine was he actually concealing? What was it that brought on the additional charge of purpose to traffic? Normally, the drug has to be past a certain amount for that charge unless he had a scale and baggies which show that intent with him. Does he have priors for drug use? If so, was he on probation or parole? Did he violate his probation or parole? Most likely he will be doing several months in county jail if it is his first offense.

Well he's being charged with a schedule 1 offence which carries a max of life in prison on both counts. He will get jail time, but it will be at the lower end of the scale i'd say 2-3 years in jail. Maybe his lawyer can plea deal and arrainge for him to get a conditonal sentence where he serves his jail sentence in the community under house arrest. I'm sorry if this sounds harsh but thats the best I can give you.

It really depends on how much it was. If he is being charged with possession with intent to distribute, it must have been a fairly large amount. Is this his first time in trouble? Cocaine itself carries harsher penalties. Where was he arrested? All these details come into play. Sorry to sound so negative,but I'm just being honest. And by the way, that is some friend to let his boy take the fall for him.

he's right. i think his family should get a criminal defense lawyer. it's worth the money. They usually take a retainer of $5000 to $8000, which they can make payments. get him bailed out too. it;s not safe in those jails. i don't mean to scare you, just advise. good luck.

At this point, it officially becomes his dope. Look up the penal code for whatever state you're in, it will tell the offense and the penality.

Can he prove he didn't know about it? And will his friend be willing to say that your fiance knew nothing about it...

How many times he been arrested before? He will defenily do some jail depending on his record.
