Is it legal for a college to enter into a contract for a program they are losing accreditation for?


My daughter enrolled in the Le Cordon Bleu School of Culinary Arts at McIntosh College (Dover, NH) in July. We just learned they have lost their accreditation for this program, which seems like breach of contract to me. Also, I just learned that her repayment of her ParentPlus loan starts this month, instead of 6 months after she graduates and the head of the financial aid dept tells us that my daughters financial aid advisor gave her the wrong information about when repayment starts, despite the fact that I made it very clear that she would not be able to attend unless we could start repaying her loan 6 months after graduation. Is any of this legal and what should we do if it's not?

Can we sue the school for this?

You were sent an application and promissory note for the PLUS loan. Repayment information was spelled out in it. Too bad you didn't read it carefully. However, the Department of Ed has some provision for borrowers who've attended schools that have shut down. You should go to ed.gov and research whether or not you'll be eligible for a cancellation of the loan due to the loss of accreditation. If nothing else, you can ask for a forebearance on the payments.

It is unethical, if they don't notify you before you sign up.
