Can I be charged with this..?


Can I be charged with the following when there is no damage on either my vehicle or his??? (Pennsylvania)

搂 3743. Accidents involving damage to attended vehicle or property.
(a) General rule.--The driver of any vehicle involved in an accident resulting only in damage
to a vehicle or other property which is driven or attended by any person shall immediately stop the
vehicle at the scene of the accident or as close thereto as possible but shall forthwith return to and in
every event shall remain at the scene of the accident until he has fulfilled the requirements of section
3744 (relating to duty to give information and render aid). Every stop shall be made without
obstructing traffic more than is necessary.
(b) Penalty.--Any person violating this section commits a misdemeanor of the third degree,
punishable by a fine of $2,500 or imprisonment for not more than one year, or both.

Basically I'm being charged with violating this law because the other car turned to his designated road, I got out of my car, and then got back in after I realized he was turning. I then left because he did.

There isn't even any damage on either of our vehicles!

I'm an 18 year old who's just about to get out of school and leaving for Basic with the Army National Guard on June 18th.. first of all I can't even afford a $2,500 fine and secondly I don't need a third degree misdemeanor on my record because I just turned 18.

You have just learned a horrible lesson that a lot of kids learn the hard way. ALWAYS call the police in every accident no matter how small for your own protection. He obviously did call them and blamed you. He might blame you for any little ding to his car whether you did it or not. You had no opportunity to defend yourself to the police who charged you because you never had the opportunity to speak to them. Hopefully the state's atty might listen to you, but don't count on it. You are young and were an easy target for the guy to blame.

Yes you can be charged with that. If you have never been in any trouble, then it probably won't be the full fine, infact they might even work out a deal for you. And if it is, then they usually put it on payments so you can pay for it over time. There is a law that says that if you are in active duty, all court cases must stop or suspend until you return from the service. This is a class 3 misdemeanor. That is not a major crime. Your life will still go on and be good. Just learn from this. Don't trust people. You call the police and have everything put into a report from now on. That's for your own safety.

contact a laywer... chances are if you go to court and they find you guilty the fine will be something like $100... if there were serious injuries or damage..then you'd get the $2500 dollar fine for leaving the sceen oof the accident... it's not that serious but don't ignore it

First of all, if the other driver fled the scene, don't fret. Your only obligation is to report it to the police (see source list).

Under Statute 3744 (a), you are not required to give information to the driver of the other vehicle unless they are a sworn police officer. A civilian driver must remain at the scene until the police arrive if injury is involved.

Since none of the occupants of the MVA were injured and the vehicles could be driven away from the scene, a police report is not required. It's a strange rule, but the police will only write up a non-reportable accident form.
