Need information on a custody battle? |
My boyfriend got his son on December 9th and the mother was supposed to come get him December 12 she said she couldn't come yet she could go to her boyfriends house which is 2 minutes from us so he went to file for custody so they have a court date this month on the 27th. My boyfriend can't afford a lawyer at this time but the mother has a legal aid lawyer, one of her family members is going to go testify on my boyfriends behalf saying the child will be better off with the father... OK so u are in the middle of it all....let's see i don't really understand why the mother could not come get her child but if she hasn't even called are tryed to come get her baby then she don't deserve the child...it doesn't matter who has more money or the better job...it only matters that the child is going to be safe and loved, Ur boyfriend could get custody for the simple fact that the child has been there since DEC 9th and the mother has had no attempt to go get her child....GOOD LUCK i can tell Ur stressed about it all Get a calendar and document everything. Times, dates, conversations. He needs to make sure EVERYTHING he does is for the best interest of the child and not out of spite for the ex. Don't go by hear say make sure everything is FACT. WHen you go to court make sure they understand it is in the best interest of the child. Good luck Documenting is truly the key in a case like this. You did not say when the mother was going to pick up the boy? Did she move the day or what? Legally there are to many circumstances to this story that you have not included. Give more details and I will give you a better answer from a legal standpoint.
