My husband is due to have his child support looked at. Any tips?


My husband is due to have the child support recalculated for his son in a month. We don't have a lot of money for a lawyer and legal aid (free/low cost lawyers) stated that it is up to Child Support Enforcement/Job and family services. No lawyer is needed. So I'm trying to gather information that might be helpful.
In the past, the county has been very difficult and past case workers have lied to us, hung up on us and told us they plain don't care. We are facing major financial hardship due to child support payments which total $306 for one child, $80 for the other. My husband is desperately seeking other work but it is just not available right now and even at his current fast food job his hours have been slashed. He only makes about $500/month. By the time they take out the child support, his take home pay is only around $120 a month. We have fought with them over the years because the law in ohio clearly states that fathers should pay 60% if they are not supporting other children, 50% of their income if they are. He has two children by me the county is refusing to adjust for. We also do not have any visitation rights set up and she has been witholding visitation. If his child support were not quite so high, we would not have to be on welfare.
Any advice, as we have finally won the battle to have it recalculated after three years of this grueling nightmare?

My husband just had his redone for the first time, and we had the help of a lawyer, the lawyer told us to bring, our bills with us, copy of our health insurance because his daughters are on our insurance, and copy of his paycheck stubs for as far back as we had, which we had a year. He was paying $1250 a month which only left him with 350 out of his paycheck, and his payments dropped to 619.50 a month! Because insurance was calculated in and our bills were calculated in. They can't take everything he has! His payments will drop just make sure he brings paycheck stubs and anything else, that relates to his children or money.

Present the facts to the judge, and cite any case law that you can find. Remember the social workers are there to save the state as much money as they can. So be prepared for a fight.

Ohio like most states takes into account parenting time. If your husband does not have a visitation order in place for the child, then the mom does not have to allow him to see the child. I'm not sure what the 60% and 50% you're talking about are as i'm sure that is not how much he is paying of his income. Most states it is 17% of income per child. There really is no need to get a lawyer since everything is determined by your husbands income. If he is now making less then he used to then you really don't have to worry about any sort of increase.

take his last three months of checks in with you. This proves what he is actually making.

Take your bills in, showing what it takes to survive.

Also, prove that you have not seen the children, nor does she let you see the children, because not letting daddy see the children is against the original ruling.

Why is the cost for each child different? That doesn't make sense to me.
