Is there a way I can bypass the parent info for the FAFSA?


I am 21 years old. My father is deceased. My mother's parental rights to me were terminated when I was 10 and I have had little contact with her since then. I have no idea how to get in touch with her anyway. She hasn't filed taxes since the late 1990's. I have been unable to get any financial aid because of this. Every one of the financial aid counselors that I have spoken to about this says the same thing: "You'll just have to try to track her down somehow."
Before you reply, please read the following:
1. No, I can't simply check off "independent".
2. No, I can't just claim some other address.
3. No, I can't put my guardians' information.
4. No, I can't just say that I don't live with her.

Can anyone tell me of a loophole? It would be greatly appreciated.

So if your mom's parental rights were terminated when you were ten, who's custody were you in exactly? Did they legally adopt you? Do you or can your guardian provide you with a paper trail of her rights being terminated? Were you a ward of the court?

Just so you know, the rules regarding dependency status has changed significantly for the 09-10 fafsa. Be sure you read all of the new qualifications. There are about 4 pages worth now.

You might look closely at this question to see if it applies to you.

Are you, or were you in legal guardianship as determined by a court in your state of legal residence at the time you received the determination (question 57)?

If it does not, you can ask for a Dependency Override from your schools fin aid office.

The only thing you can do is go to a judge and have yourself declared independent. Under your circumstances you might actually have a shot since your mother's rights have already been terminated and your father is deceased. The only other options are to wait 3 years to go to school. Or to track her down, but that seems unlikely.

File a Dependency Review Form, explain all of your circumstances and provide documentation of the legal severance with your mother if you can. If the Financial Aid office wont help you with this then go to the director, or dean of students if needed.
