Birth Certificate issues ? |
My brother and parents have joint custody of my nephew (my brother was a minor when we got custody) the mother relinquished all rights to him (he was taken way from her and placed in foster care when he was a baby) we have had custody of him since he was 1, he is now 4 and we have been trying to get a birth certificate for him ever since then, at first we applied to get a copy, we filled out the form twice and paid the fee twice, we were then told that he had never been registered, after some investigating my brother got CAS (the Children's Aid Society) to send him a form to apply for the certificate and was later told that the only person that can fill out the form is the mother!!! my brother got into contact with her 4 weeks ago, sent her the form and we still haven't received it, my brother has never received any baby bonus or child support!!!!!! he doesn't care about all that he's mostly worried about my nephew having to go into school soon!! does anyone know if there is another way for him to apply for the birth certificate without needing the mothers information? is there some organization or person he can speak to so he can get this settled once and for all.... she relinquished all rights why should we need to go to her and beg for this when it should have been done years ago!! You should not have to beg her for anything. There must be a procedure for something like this. What would happen if a mother died giving birth? She certainly would not be able to complete any forms!! I bet the...father would fill out the forms. Sounds like they're giving you the runaround. Stick to your guns. Get legal counsel, that sometimes will expedite the issue, or at least get you some answers. Get a lawyer to help you with this. It'll cost some money, but it will help move the process along much quicker and prevent issues down the road. It doesn't surprise me that you're having so much difficulty getting a birth certificate. I lost mine years ago and it was nearly impossible to secure another one. Anyway, why don't you try contacting your local MLA and see if he / she can give you some help in this. They are very influential in all matters of the government when it comes to representing the people of the community. I'm sure he/she will be able to get things moving for you. Good luck. |
