Getting custody of my son.?

The mother of my child isn鈥檛 very suitable taking care of my son (he鈥檚 5 yrs old). At a point in time when I was out of town almost got my child taken in custody by CPS (child perfective services). Her Mother took my son from her and put my son with her sister (his aunt). The aunt has my son and I discussed with her about getting my son but I get no respond. So here is the problem. She鈥檚 trying to put me on child support because she has him (and I want him). She moved out of state to California (I reside in Las Vegas). I just received paperwork in the mail about her applying for federal aid housing. She uses my son at her expense. How do I go about getting my son and canceling all this stuff she is applying for with me and my son鈥檚 information? Help please.

If she's been out of California less than six months, you need to counter file there, as it and Arizona are the only states where single fathers have any assumed rights to a child. I'm curious why you weren't already on court ordered child support?

Many think the courts are rigged against dads, but in reality, it is more about attorneys unwilling or lacking the knowledge to truly fight for the father's rights. This is why it is important to learn how to interview and hire the right attorney. It is also important to do as much as possible on your own and not pay the attorney to do it.

Start keeping a daily journal of all your activities. The most common way to prevent a father from getting his rights through the courts is a false allegation, usually sexual. Over 60% of divorcing father are accused of child sexual abuse, of which only 4% are found to have any relevance, but there are no penalties for doing so. A daily journal is your number one piece of evidence in court and you can even refer to it while on the stand.

Gather evidence. Check the site below to see if it is illegal to record conversations without the other person knowing. If your state does not have a law either way, than it defaults to the federal ruling which says one person in a conversation must know they are being recorded. You鈥檙e that one person. In Missouri it is specifically legal, in Kansas there is no mention either way. If you live in two different states, and one has a law against it, than it applies when the call originates from within that state,

Now, you can't just record, you also have to transcribe it into the daily journal.

Why haven't you got your son already. Are there reasons he is not with you, like criminal record, drug use etc. If not most courts would rather see the child with a biological parent. Are you able to support him, do you have a job, home, childcare available while you're at work. If so there should be no reason why you can't get your son. Start proceedings NOW.

your the father! they should have contacted you first! go to court and get your son! she is just using him and i would let the court know she can't provide for him if she is applying for hud!!! go get your son!!!
