How do I get my car back?

My sister stole my car that has no liens and I am the only one on the title, she gave police false documents saying I owed her money, true I owe her 100.00. She took a check to the DA's office in which we were joint account holders, I just wrote it to her telling her sissy I could never repay you for what you have done for me, so keep this always and know that if I were rich this is what I would give you. She took it to the bank and acted like she tried to cash it,came closed account, because we closed it a month before.DA sent it back to her, telling her no go. Now they say it is a civil matter, and will not get my car back after they aided her in taking it, because they did not do the research to see who was the legal owner. I do not know what to do, I am old and need this car for doctors appointment as I am in poor health. What can I do, I cannot afford an attorney, as I am on social security.

The fact that you owe her $100 does not give her the right to steal your car. I see you mention the police in your story. Did you report the theft to the police? This is not a civil matter; this is a criminal matter. She stole your car and should be charged as such. It sounds to me like the police just don't want to get involved, but I don't see how they can avoid it. And the assistant DA sounds like he's just not doing his job. I'd go over his head and talk to the head and talk to his supervisor. If they won't help; you will have no choice but to take her to civil court.

Not much you can do like they said, this is a CIVIL matter..

Meaning you have to settle this in CIVIL court..

If you cant afford a lawyer you will just have to file the paper work yourself..

You need an attorney to sort this out. Otherwise you will never see your car back. But you can get legal help if you can't afford it.

If you know of a Senior Citizen's center in your community, call them and ask if they have a lawyer or legal aid service that can help you.

Search online for "legal aid" and see if there is anything right off in your area. Check your yellow pages too. And you can also contact the local American Bar Association who can refer you to an agency.

If not, call your county clerk of court and ask. They should be able to refer you to the right place for help.
