Do you think that students with AIDS who are attending public schools in the US be....?

identified to their teachers and their fellow students?

Why or why not?

I am doing a debate in my speech class and and doing research for this topic. I will not know if I am doing pro or con until the day of my debate!

thanks a lot!!

Oh my gosh no, in as "identify" I mean students and teachers should be aware of their disease!

federal law actually prohibits this from happening.

it's called HIPAA and it prevents anyone's medical information from being shared with third parties.

i don't feel this should be shared. the results would be devastating to the individual involved. not only would they be endlessly teased (b/c most school aged children do not understand that aids is not passed only through sex), but they would also be avoided in school (have no friends) and some might even commit suicide b/c they can't handle being bullied anymore.

even in a hospital setting-staff is not allowed to test a person for HIV w/out the person's written consent-if they refuse, the test is not done.

America is a nation of freedom for a reason and i think things as sensitive as personal medical info should be kept private.

if the person is sexually active, then i do feel it their personal responsibility to inform their partner and take the necessary precautions to avoid spreading the illness.

i guess so i mean they are people..........

yes definitely. there will be some pros and cons to it though. for one people will think differently of you,you cant help the way people think. kids will act differently for sure, treat you differently, it would be tough to deal with. but on the other hand if they were to get hurt at school, or if kids got into fight, people need to know. because then they would have to take special precautions.

No............I dont teachers do not always keep secrets. If school kids found out or whatever that would be a big big mess!

Aids is only contagious if these children are going to be sexually active with this person, sharing needles. We all know at this point what causes it. I would hold an all school assembly/meeting. One for parents. One for students. Have specialists speak about what Aids is and isn't. I think it would be better in the long run as to avoid panic and confusion. Our school did this when we were younger, as we had a boy who had a terminal illness. I sure am glad they did because the boy ended up having to be life-flighted from school in middle of day and later died.

No. The school's nurse should be made aware in case of emergencies, but no one else. Kids are cruel enough without giving them additional ammunition. Besides, it is none of their business and is not a contagious disease, like mono, etc.

The likelihood of contracting AIDS from a nosebleed is slim to none. You would have to take their blood and put it in your mouth or eye, and it would need to be a significant amount. Still, the chance would be slim. I was in the delivery room of my best friend's baby (my best friend had AIDS) and doctors didn't even require gloves as the chance is non-existent. It saddens me that teachers can be so misinformed to think otherwise. Maybe they should do their homework.

yes and no no because it could lead to discrimination but yes to warm people who might become intimate with him and/or her

NO not at all the only people that should be aware of the health problem is the school nurse and the principle, know one else needs too know they still have rights's.

no...its the individuals own business. the school should have programs in place that teach children to be careful in general.unfortunately people still get discriminated becoz of their status so they should hve to be made to disclise their status coz that will set them up for abuse...do u think all pple with syphillis should be artted out too. what happened to privacy???

As a teacher, I would like to know. I would like to know becaue things can always happen. Sometimes you react without taking precautions. I will give you an example: Last week, a child fell on the playground and hit his noes, and and blood gushed everywhere. THe teachers assistant, just dived right in and cleaned him up without gloves! THings like that do happen. There are cases of AIDS where children have it, and no one knows how. THere are about 98 cases in the United States right now. We need to be aware because what if the child needs special attention during a field trip, or if they are at a sporting activitiy. I am thinking more along the child's safety, than worrying about who will contract it. I just think that sometimes you need to follow the rule, better safe than sorry.

No, no one needs to know if a person has AIDS, unless that person choses to tell them. As far as the dangers of spreading it, certain procedures such as proper handwashing and blood/waste handling procedures should be in place and be used with everyone...regardless of whether they have AIDS or not.

If you did identify individuals with AIDS, then they would be avoided and harassed and ridiculed.

The exception to this is sports. If a person has AIDS, it should be documented and taken into consideration before the person is permitted to play a sport, especially one that could easily cause transmission of the virus. This information should be kept confidential though (between individual and nurse/ coach only).

I would want to know if my child was in a class with another child that had AIDS. If I was going to be exposed to something of this magnitude, I would want to know! I understand that the other person had rights ... but like someone else said, things happen!

Teachers should be made aware of it just as we are made aware of who has allergic reactions, who has diabetes, etc. It's no different than those, in my opinion. Students, on the other hand, need not be informed (for obvious reasons).

Look at the signs of the times...People are being harassed, beaten, and sometimes killed simply because of someone else's ignorance. AIDS is a very sensitive issue that some still care not to learn about. Why subject an innocent person (who may have been born with it) to anymore cruelty than that they carry within their own bodies. In these times you cant be homeless, gay, or in anyway different to some with out walking around with a target on your back. Face it some people are cruel. It should only be knowledge for their family and health care providers. As far as the school nurse she should be trained to protect herself in every situation. AIDS is not the only thing a person could contract by certain contact. What about herpes or hepatitis? Can't put a label on everyone.

David Filo of Yahoo carbon crap sucks to the extreme.
He obstructs freedom of speech as he does not like us to comment on his **** hair style. 'cos he is the official of yahoo he has the right to discard my comments and questions under the "pretext" of violation even though I see all violations of all types in so many posts on yahoo the suck answer crap.

No! Promiscuos Students in Schools are not being Labeled! Furthermore, that is where the AIDS is originating from. So if someone aquires AIDS from a result of their sleezy activities why make an Issue out of it?

No, for two reasons,
One: The school nurse, who is bound by HIPAA laws, should be told. If that child is then in any risky incident, the nurse should be told about it, as with any other injured child. Nowadays, blood injuries should all be handled with gloves and proper precautions.
Two: Telling teachers and students that someone in their class has aids is sentencing that child to ostracism, bullying and vile behavior by students and the parents of those students. Unless this child is going around and having unprotected sex with other children in their class, injecting drugs and then sharing needles, or engaging in other known risky behavior, then the risk to the other children in the class is negligible. The idea that we need to know everyone's Aids status is born out of fear and nosiness. Ask yourself if you would want everyone knowing your child's medical history if he had a minimally contagious disease that was not posing a risk to fellow students. Then ask yourself if you want your child bullied and denigrated for having a disease that, as with most children, they were not responsible for contracting.

Definately not. Only airborne dioseases should be announced. AIDS is so difficult to cope with. Imagine all the trouble the kid would have to go through. he would probably be discreminated.. even though its against the law. That's such a private thing. Unless he's a sexually active kid it's no ones business. Even in adult cases, not even law enforcement officers are allowed to tell anyone that a certain individual has aids. even if he's going around spreading aids purposely, so the same should go for kids.

Oh, of course not! Their AIDS status has absolutely no affect of the classroom situation, and only becomes an issue for them in their personal relationships, to be discussed with an intimate partner. It is no more relevant than having to identify students with haemmoroids or cystitis!

I have read some of the comments left on this question. Seems like a lot of people would like to know if their child, or a student or a patient is infected with HIV/AIDS. The question isn't about would I want to know, yes everyone wants to know for their own reasons, but the underlying question is should this persons privacy rights be violated. VIOLATED, because we are all entitled to this right. There is no obligation to releasing your personal medical history to anyone. HIPPA is the correct term for this privacy law. Basically you are entitled to keep your medical history private unless other wise authorized to via medical authorization. We are a country built on rights and no one wants to have their rights taken away from them to satisfy someone elses curiosity. One last thought, since aids broke out in the 80's there have been and are mass campaigns to bring awareness and to stop the massive spread of this disease. Funny thing is that with this knowledge that we have of aids and how to contract and how to protect ourselves from contraction and people that CHOOSE to disclose their medical condition in hopes of stopping this epidemic, hasn't helped change any less the spread of this virus by the number one way to contract the virus, SEX.

Yes 100% yes! While it my be embarrasing to the student. Others have a right to know so they can be aware and try not to catch it. This disease will kill you. they do not have a cure! In fact I think anyone who knows they have it and dont tell their partner should be charged for murder. other wise it will continue to spread!

well I would say yes that others should be informed because of the bloody nose thing. It should be up to the person that has aids if they want people to know about it.

i think that the students who have aids should be identified because there are many risks of spread.

maybe the faculty should be aware, but not the students. i work in a school and almost all the faculty is aware of the students that might require special care. however, there is no way that the students should know. you are taught that you should be careful when around other peoples blood anyway. how do you choose what medical conditions should be told to everyone?

A person with AIDS is usually very responsible for the safety of others. I think if it were known that they had the illness then they might be shunned by others. And its a sad enough life anyway. The teachers, perhaps, should know the facts but it is not necessary to tell every Tom, Dick, and Harry.

Yes the Teachres ned to know but the students I dont think is a good Idea---the person will be Ostresise from classmates ---but on the other hand a person can get Tuberculosis faster on a classroom than the Aids

think no.they are likely to face an amazing amount of prejudice wether people are willing to admit it or not.and its against human rights (if it isnt it should be)
its hard to explain but i think its really infair.it should be ones choice if they want to release they're status or not.

i only think that nurse schould now. It personal information. If the person dose not care then yes that is fine, the nurse schould only now because if they get hurt and bleed they have to be extra catuion but are they not anyway

That is my response. my best friend has haid and she got it from her parents so she dosent mind to much if people know

it all depends on the person but good luck with your debate

I think they sholud be identified to their teachers so they know how to handle the situation, but not to the students, b/c students can me verry harsh, but insted every one should be treated the same and all accedents involving blood should be handled with caution no matter the situatition and the students should learn this in order to be carful.

it is that person privacy to tell if they have AIDS. by telling everyone that you have the infection you could be push out of society specialty if you are in high school. there is very little risk in spreading AIDS.

well you guys ask some of the weirdest questions you know that
