Why couldn't I sue my high school for not providing sex ed? |
So this may be a retarded question, but it popped into my head while talking to a friend of mine from school who recently contracted herpes. We went to catholic school where, of course, abstinence only education was the only option. It got me thinking though...I mean, we never discussed how to prevent std infection through any other method except abstinence, leaving us completely unprepared for the issues presented in adulthood. I mean, they told us what the symptoms of chlamydia, gonorrhea, herpes, AIDS etc. would include, but honestly, that was the greatest extent to which we were taught. Personally, I've always been an advocate for safe sex education, but this situation really made me wonder, so please, enlighten me. Thanks! A private school especially is a matter of contract. If you (or your parents) wanted a school that taught things differently, you had the option of going to a different school. A public school has no such contract, but a lawsuit depends first and foremost upon the existence of a duty. When someone runs a red light and hits you with a car, the basis of the lawsuit is in the duty to stop at the red light. Some duties involve reasonable care instead of some specific statute, such as the duty of due care, but that does not give rise to a duty to teach any specific subject other than whatever duty may be imposed by the contract. A school system is not legally required to ensure you have a specific piece of knowledge. Better to sue your parents for sending you to a backward, anti-scientific, myth based school. Because it is not your option. Your parents, along with others, determine what will and will not be taught. Sue your parents. Ultimately, they are responsible for your upbringing. Because you could have figured out how to use your own hand. If you're school taught you the symptoms of certain STD's and the most efficient method of preventing the contraction of STD's (which is abstinence) then they did offer a "sex ed" course. Life is about decisions kid! Some people make the wrong decisions while others make the right decisions. I suggest you learn from your friend's mistake. You know exactly what an STD is and how to prevent them. Life is not a free ride kid, but you're free to think it is. However, I can say that those people who think life is a free ride usually end up as losers and failures at life. Your friend messed up. Instead of trying to sue someone for her own stupidity she should thank god that she didn't contract HIV, or HEP C. Yes this is a stupid question because you already know the asnwer. Kids these days.... |
