Why would states require a blood test(AIDS) before applying for a marriage license?


We just got our marriage license yesterday and they told us that Michigan does not require blood tests. Why would any state require it? People with AIDS cant get married? Is that a little unfair? Im just wondering what other people think.

Well, a blood test and an AIDS test isn't necessarily the same thing. States have required blood tests before marriage for decades, and in the old days it was to make sure people weren't related before they got hitched, or to test for many different blood diseases. Just because old laws require brides and grooms to get blood tested, doesn't mean it's for AIDS. And people with any disease can get married, there's no law against it.

The blood tests are not intended to prevent anyone from receiving a marriage license.

They are intended to prevent deceit and inadvertent transmission of blood-related diseases. As long as both partners are aware of what diseases the other carries, then they are free to make the decision of whether or not to marry.

It would be considered a marriage (a legal contract) performed under concealment of relevant information (medical history), and would be illegible for an annulment.

I don't think any state requires blood tests for AIDS as AIDS is basically a legislatively protected disease. If you end up in the hospital and you have an AIDS test come up positive, the hosptial can't inform your spouse, so I don't know why the state could.

Montana requires a blood test for the woman to see if she has been exposed or vaccinated against Rubella. It's actually an antiquidated procedure and really none of the state's business, but it remains on the books. In fact, it was considered a few years ago to be taken off and the legislators let it remain.

That is a bit prejudice on your part.. this is a health issue.. just a few decades ago a couple would get blood tests for not only veneral disease ie STDs but the girl was tested to make sure she didn't need an MMR shot as German measles would kill babies in the womb. It was all about safety for the couples and it should be standard for all states.. it was those activists that eliminated the blood tests which I felt was one of the stupiest things ever done. Now that STDs are rampant and nobody wants to be honest with their partner anymore.

There are only a few states that require a blood test before marriage. They do not prevent you from getting married. The test is just so your future spouse knows what they are getting into.

It's probably to make sure that both parties know whether or not they have AIDS. I'm pretty sure no state bans anyone with AIDS from getting married, but there are a lot of people out there who are positive and either don't know it or don't care.

The blood tests are to check the likelihood that your children would have a genetic deficiency, I thought, not to prevent people with AIDS from getting married. Either way, most states don't require them anymore and they're just optional.

People with AIDS can get married. The government just wants to be sure the other person knows it before getting committed to them and having children. Plus, 1 in 3 people with HIV don't know they have it.

I think it's a good idea.

My guess is that in whatever states that require this there was some precedent setting case where a spouse sued the other for not disclosing that they were HIV positive prior to getting married.

First I heard of it though.

people with AIDS can get married, but the state would probably want the spouse to know if the other had it. If they didn't know, they could probably file a law suit or get AIDS themselves.

All states should require it to help stop the spread of disease's
