Please help a mother trying to get a divorce with a two yr old!?

I am only 17 yrs old and im trying to get a divorce I have a two year old. I have a paternity test that say that if my child has resided with me for 6 months or longer that i have full custody of her. Well i married the father of my child and he never went through with the the custody so she still has my last name and he is still not on the birth certificate. well now im trying to get a divorce and i was wanting to know if on my divorce papers i can put on there that i have full custody of her?? I have called legal aid many times and they cant help me cuz of my age! Im so tired of this! i just want to get my divorce over and done with. if anyone knows of a lawyer that i can afford and get help from please let me know. I dont know az laws but in NY if he is not on birth certificate and there are no custody papers then YOU have custody.

Honey, it sounds as if you've already answered your own question. You say that you have a paper stating that if your child has lived with you for 6+ months that you have full custody of her...then I'd say you have full custody of her. Either way, you're the domiciliary parent because he didn't go through with the custody papers. Until such time as the judge states otherwise, you have custody of your daughter because you didn't list a father on her BC.

My advice would be to contact an attorney that gives free legal consulation, don't give your age and have your questions answered, fears alleviated and finalize your divorce.
