Help on this debate pleasee?

i have a debate in favor of the cure for AIDS in 1998 here are some details;
the people VS. the u.s supreme court (we support the people by the way)

facts:
the drug was found in 1998, drug was tested in curing 50% and the other 50 % suffered cell/muscel/life degenerations.

the FDA deamed the drug unsafe and they are unwilling to open to everyone

100 people were tested on the drug

the argument : should those who have AIDS already fight for the drug, even though it is only 50% affective?

i need some questions that could counter the supreme court i already have 2

1) people with AIDS should be able to take the drug even though its only 50% because it was their choice and its their right to do so.

2) as the population 1998 is rapidly increasing most likely the #'s of AIDS infected people are too, so why not use the cure to TRY to lower the rate of AIDS recipients.

please help, i need basically any argument i can present to the supreme court and win the debate(=

The rights that are supposed to be protected in the Declaration of Independence, which is considered to be the founding document of the United States of America, are life, liberty and the pursuit of happiness. One could argue that these rights are being infringed upon when a medicine that could likely give them in their minds "life" or at least an extension thereof, or to go as far as to say they are pursuing happiness, they could be miserable with aids, therefore they are not being allowed to pursue a full and happy life even if it means taking a chance on there life, which is also theirs to hold and to value how they want. Chemotheropy is used on cancer patients but it may result in death as well, it is still allowed because there is a chance that it may kill the cancer and heal them, this is the same principle.

My take is people should be able to choice what they want to do with their body, whether it's Canadian RX or illegal drugs or assisted suicide....the government should have no right to interfering with it.

The only exception is if the person is decleared insane. in that case. they should not choice on their own.
