How come after 3 prior DWI convictions this illegal was not deported now mother and her pregnant daughter lay dead and why wasn't the illegal deported ?
CONROE 鈥?A 27-year-old illegal immigrant with mulitple DWI convictions pleaded guilty this morning to felony murder charges in the death of a mother and daughter in a car accident more than a year ago.

Ignacio Gomez-Gutierrez, of Houston, through an interpreter, also pleaded guilty to two counts of failure to stop and render aid.

The case being heard in Montgomery County's 9th District Court is the first felony DWI murder case in the county, prosecutors said.

Gomez-Gutierrez is accused of driving with a blood-alcohol content that was three times the legal limit when he plowed into the rear of a car on U.S. 59 near the entrance to Kingwood on March 25, 2007.

The car's occupants, Maria Ortiz, 49, and her daughter Vaness, 18, who was five months pregnant, were killed instantly.

Gomez-Gutierrez fled from his disabled vehicle after the wreck, investigators said.

With Gomez-Gutierrez facing his fourth drunken driving charge, prosecutors elected to upgrade charges to felony murder instead of second-degree felony intoxicated manslaughter.

State law enables prosecutors to pursue the more serious charge because Gomez-Gutierrez caused a death while committing a felony crime.

Gomez-Gutierrez served time for three prior DWI convictions in 2002, 2004 and 2005 but authorities did not deport him to Mexico.

In 2005, Gomez-Gutierrez was stopped for running a stop sign in Harris County. Officers said that he had a strong alcohol odor and failed a field sobriety test.

He pleaded guilty to a misdemeanor and was sentenced to a year in county jail. He was released in six months, records showed.

A Montgomery County jury will decide Gomez-Gutierrez's punishment in the latest case, or he could agree to a plea deal. Opening statements will resume this afternoon.

Gomez-Gutierrez faces up to 99 years in prison on the murder charges and up to five years in prison or a year in jail on the failure to stop and render aid charges.

Houston is a "sanctuary city" that does not report criminal convictions to ICE. Get on your mayor, City Council, state legislators & governor and demand that Houston and the state of Texas join the new program whereby local law enforcement learns to work with ICE and present cases of illegal aliens to them. Also demand a state law prohibiting any city/town from failing to cooperate with immigration authorities anytime someone not legally present in the US is arrested/convicted in connection with any misdemeanor or felony. It is up to Houstonians and Texans to protect their rights as citizens of the US and residents of this city/state.

Organize! Vote for better officials. And if you know of any illegal aliens or employers who hire them, report to the ICE Hotline with all the info you can possibly gather.

Get used to hearing about this with Obama as President. This is how bleeding heart liberals run this country. They don't have the heart to kick out criminal illegals.

I do not know why but the American authorities are to blame. There is simply no excuse for this. He was illegal and should have been deported. The minute the local police find out you are illegal, they must by law give you to ICE and ICE will deport you. There is no extra funding or hearing needed for this. It is a simple administrative procedure. Do not let the lawyers or special interest groups fool you.

I know and understand your distaste, and i feel your pain i'm in court rooms everyday seeing cases like this and it is teeth clenching. I being a Mother myself. I do know for a fact that this individuals must serve there time in prison when sentenced and when there release from prison is up they will have Homeland there to pick them up and Deport them. perhaps this will give you some hope.

To the person that says Houston is a sanctuary city it is no longer!!!!! Passed in 2006 or beginning of 2007 when a person is now arrested in Harris county They check their immigration status.Even if they are arrested on just traffic or minor crimes. But as I said this was just passed I think in early 2007 after an illegal immigrant killed a police officer. But I am suprised that this guy wasn't deported before as even before 2007 if a person commits felony they usually checked their immigration status and deported them so I don't know just one who slipped through the system I guess.

And if he was arrested the prior times in montgomery county their system maybe different and that is why.

Well, I guess only the immigration department can answer this one!

If you notice that the states with more illegals are down towards the bottom of the list for DUIs. So that means that illegals are less likely to commit such accidents then others.
