It is illegal for a man who knowingly has aids takes advantage of a brain injured woman in a nursing home?

Both live in a nursing home. I don't know if the man has other problems as well, but the woman found out about the aids after the fact. He did not tell her. The nurses told her and now she has to go for testing. The woman was in a terrible car accident 10 years ago, not her fault, and was in a coma , and couldn't raise her son. She is in a wheelchair. She is in the nursing home for life.

Depending on the state they live in, he can be in a heap of trouble.

Actually in many states it is not (unfortunately) illegal to not inform your partners about having HIV. In terms of having sex well it may or may not be considered rape. It depends on many factors, the first is was she able legally to consent to the sex...that depends on her capabilities. The next is was he? This is a situation where the police and social workers should be called in.
That being said the people who may really be in trouble here are the nurses! Depending on the the method they used to inform the woman about her exposure to HIV. If they contacted the state infection control or the CDC than the woman was informed by state or national officials they are all set. However if they simply told the woman that the man had HIV and she should be test they have violated the mans right under the HIPPA laws and they could and should lose their right to practice.

I'm pretty sure that's a felony,and he could be charged with attempted murder.The guy knows he has A.I.D.S. but yet he chooses to have sex with someone who has no way of protecting themselves.That could be considered battery too,or something along those lines.

Probably is assault of a deadly weapon maybe it depends where do you live? im pretty sure he has to get arrested and go to prison
