Social security disability questions?

Is it normal to be disapproved after the initial application? I have been dx with bipolar disorder and social anxiety disorder and OCD..

I am in the process of hiring a lawyer, but who determines if you are disabled? A judge? I have neurology reports of lesions of the brain caused by migranes too. It has only been a year since my dx, so when I go for my hearing does it have to be two years since the diagnosis?

My health insurance copays are completely outrageous, and I can not afford the meds or appointments at this point. I dont qualify for state aid, so are there other treatment options for me??

exactly why I dont qualify for medicade is because my husband makes too much, but not enough for me not to work.. if that makes sense.

It is very normal that you were turned down the first time. social security has panels of doctors who look over your records and make a determination if yu are disabled or not. many times people are turned down simply because social security just did not have enough information to make the judgement. you have to get with every doctor and talk with the receptionist or hospital social workers and they will speed up the process for you or request you records and you mail the to ss yourself.

Absolutely- it's pretty much standard procedure. Hang in there. They want to discourage people from continuing their application.

If your case gets to a hearing then it will be decided by a judge. But even the, a lawyer can appeal if the judge doesn't answer the claims properly. That's what happened to me and its still in appeal. Good luck to you.

Yes it is normal to be disapproved after the initial application. I am going through the same thing. You should hire a lawyer and request a hearing. I believe it will be the judge who decides if you are disabled. The hearing will be scheduled approximately 6 - 12 months after you request it. The thing you need to know is that they are looking for your doctors to specifically state in their report that you will be disable for at least one year. How long you have been disabled is irrelevant - how long you are expected to be disabled is the key. Make sure your doctors state that in their reports.

About your health insurance...I assume you are applying for disability because you are not working? If you are paying for your health insurance, you might want to drop it and apply for medicaid. If you are not working, you should have no trouble being approved for medicaid. (unless you are married and your husband is working)

About your medication - contact the manufacturer of the medications. Sometime they have programs to help you pay the co-pays.

You will have to see your Psychatrist and have him fill out a few forms I believe. My boyfriend and sister are both applying for it. No word yet, but from others I heard they will probably disaprove your claim a couple or more times before they accept it. The good thing is that once you do get accepted you get all that back pay. A doctor determines if you are disabled or not, so you will want to see him and even have him appear in court. Most charge a fee. Why don't you qualify for benefits? You must work. You have to get paid under a cettain amount of money in order to recieve Medicad benefits. My boyfriend only pays a few dollars for all five of his meds. I pay about $25 dollars each with Aetna my employer's insurance. You can get food stamps and other assitance in the meantime. Hang in there.

I am sorry to hear about your illness. It is common for the initial claim to be denied, however, If you send in all medical reports related to your illness they are more likely to rule in your favor. As for who determines eligibility, it is based on the physicians hired by the social security administration who reviews your case, You may be required to have an independent medical exam, which is a preselected Physician who will examine you and send the report to the judge, who makes the final decision. The only draw back to hiring an attorney, they will drag the process out over a long period of time. the reason the attorney does this is that you will be paid back payments which could be quit substantial and they will receive a large portion of your back payment.
