Is it illegal to dock someones pay for the time they spend receiving first aid treatment?

I have a disability (POTS) and i started working for an agency back in October. Before i started i let them know all about my illness and i told them sometimes it gets the better of me and i may end up in the first aid room. They said that was fine and they took me on.

I am usually ok working but some days my illness gets the better of me and i end up spending 20 minutes or so in the first aid room while i get sorted. This has only happened a couple of times in the last few months, but now my work is saying that every time i go in the first aid room i will get my pay docked for the amount of time i spend in there.

Now i am wondering is that even legal to do so? Docking someones pay for receiving first aid treatment.

They don't have to pay you for not working, sweetie.

It really depends where you live and how you are paid, such as a wage or salary. You could contact your union, workplace advisory group or, if you don't have either of these, whatever legal entity looks after labour legislation in your area. You should know your rights and responsibilities as an employee.

Its legal, and not hiring someone for a disability is illegal. But if you say that working is helping to cause you to go to the first aid room, then its considered being hurt at work and they can't dock pay. They might be thinking that your just trying to get breaks and stuff.

There is no law that requires employers to pay employees when they are not working. The ADA might require the employer to make accomodations, like making first aid available, but does not require that they pay you for anything except for actual work.
