Three children given bogus / expired vaccines.?


My little brother and sisters where patients of Dr. Romillo in NJ.
He was just found to be giving out bad vaccines after investigation from threating someone with a gun.
Does my father have grounds for a lawsuit? He feels very betrayed and is very worried about the babies getting sick from something they should have been vaccinated against. What should he do. We have never had something like this happen to us and we are not sure where to begin.

Thanks for all your answers. I think I am going to wait for more information to be released and find the children a new doctor first thing tomorrow.

Steff -- it's understandable that your dad would be worried ... I think any parent would be concerned! Yikes!!!

It may be too early to assess if you have grounds for a lawsuit ... as the article said:

"Parents with children who were immunized by Romillo have "no reason to panic," said Dr. Eddy Bresnitz, deputy state health commissioner and state epidemiologist."

and ...

"Dr. Ella Boyd, public health coordinator of the Ocean County Health Department, said the county collected the vaccines seized at the doctor's office.

"To my knowledge, I don't believe that there are any children out there that could have been harmed other than not being immunized," Boyd said. "We don't think any one was adversely affected, but it is an ongoing investigation."

The article also hinted that the State may/will be able to tell from records who received what vaccine.

Certainly you could contact an attorney -- there are jillions of them out there waiting to take malpractice suits ... but if you do go that route, try to get the best one you can (Google their name, etc., and see if there are any "reports" or comments about them) ... and you ought to be able to get a malpractice attorney that will take this on a contingency basis -- meaning that if your dad loses, he won't have to pay attorney fees. (The downside is that contingency fees can run as high as 50% of the award -- and often are 33%.) -- so "shop around" on fees as well.

You can sue anyone for anything, but it doesnt mean you will win. Do some more research before you decide. See another doctor to see if they should be re vaccinated.

Consult with another doctor about what to do. He should be able to find out about the vaccines the children did recieve and if anything else needs to be done medically for them. I doubt that there are grounds for a lawsuit You would have to show damages. As nothing has happened to the kids they have not suffered any harm. Good Luck and hope all turns out well.
