Would it be legal to sue the FDA for discrimination against gay and bisexual men for baseless discriminating against them and not allowing them to donate blood or tissue?

And don't say that they are a higher risk for spreading STDs, because under the same logic anyone who's black and Hispanic males should be banned too.

In addition, the ban is for life for male to male sex, even if it's safe sex with a condom and even if it's only once. While anyone else can donate blood or tissue 12 months after any inappropriate activity such as injecting your self with unsanitary needles.

The thing is that they discriminate against gay and bisexual men regardless of weather they have or do not have STDs. In addition if, lets say a man was curious and tried male on male sex even once 30 years ago he still can't donate blood while you could be a "player and have sex with 50 woman in a week and be allowed to donate.

While most risky behavior has a 6 month - 12 month ban to allow any STDs to develop to a testable level, male on female sex is not banned at all and as expressed in the aforementioned paragraph someone who has had unprotected sex with 50 woman in a week could than go to donate blood and test negative even if he was positive because HIV and AIDS aren't testable for, sometimes, up to 6 months.

And while the above case can happen a man who had male on male sex once 30 years ago still can't donate blood even f he test's negative for all STDs

I agree with you 100%! There are people dying out there that dont have enough blood and tissue and the people taking the blood are being picky about whom then take it from! When you donate blood they first check the blood (obviously) before they put it in someone else. If you are disease and STD free then they use the blood if not then it is throw out. Why cant they do the same thing with gay people? I know more straight people with STD's then I do gay people! its not fare in anyway!

Would you accept a transfusion of blood if there was even the remote chance that it was contaminated with a possibly fatal disease? How about your loved ones? If I was the parent of a boy who had say hemophilia, then yeah, I'd be all for "discriminating" against the possible transfer of disease to my child.

Sorry, but public safety overrules your hurt feelings. It is 100% about STDs. I don't want political correctness when it comes to my life and the lives of my loved ones. Get over yourself.

No, because there is no constitutional right to donate blood. What harm do you incur by not being allowed to donate blood?
