HIV-positive man sentenced 35 years for spitting at officer, is this insane or what way to high a penality?

35 years in prison for spitting at a police officer first of all. The jury did not use common sense. Aids can not be passed on to the police officer unless they are both wounded in some sort of way in the mouth. People spit when they talk a lot dont understand why hasn't more people been convicted for crimes like this before

Wow, some of your answers amaze me and make me fear for my daughter - she is HIV positive. I thought more people were knowledgable on this topic. It is impossible to pass HIV in this way. It does not say this man has AIDS, he has HIV and if he is regularly taking meds his levels are so low that the percent chance of infection would be impossible. Even if he is not you can't pass it this way. HIV is not found in saliva, it's in blood. What kind of message is this sending for the children of the world who have HIV? It cannot be passed this way. I agree in punishment for assalt, resisting arrest, etc. But not spitting in relation to his HIV.

One can make a legitimate argument that this case of "spitting" on the Officer was in fact attempted murder. The felon (Mr. HIV Positive) knew he was carrying a potentially fatal virus and he knowingly attempted to pass this virus on to the Officer. This is obviously not a case of someone saying and spraying (spitting as the speak). As for the jury not using common sense, it appears to me that perhaps you are the one not using common sense as you failed to get the facts of the case and are simply relying on the headlines.

This is called sending a message to low-lifes that such behavior is not to be tolerated. If you think it is okay, let some aids infected criminal arrested multiple times in his life spit in your mouth. How do you know aids cannot be passed this way? Just because propagandists say it can't does not mean this guy did not intend harm on the police officer. Aids is a deadly disease that is spread through human contact. We are still not 100% sure about anything involving this disease. I say take the piece of garbage and hang him from the closest tree but then I am not as enlightened as people such as you.
