Would you consider it a crime?

to have sex with someone if you were hiv positive?
if so what would the crime be?
need there be malicious intent?
and what about the right to privacy and the other person's responsibility to protect themselves?

first of all i asked if you would consider it a crime - not if it was (because it isn't) there is a bill in legislature to make it a crime to knowingly expose someone to a communicable disease, but as of yet it is not a crime. this doesn't stop anyone from taking another person to court currently.

It's a crime to transmit any communicable disease, especially an incurable one, to someone else. You have a responsibility to inform potential partners or friends if you have any disease they can get. There is no such thing as privacy when you have the potential to kill someone. Just ask Typhoid Mary.

it is against the law to knowingly have hiv and have sex with someone without disclosing it to them before hand. there is a man in ny currently serving 10 years in prison for doing that very thing. also in my state, wa, another man was just convicted of it it too!!!!

to knowingly have sex when u r hiv pos. is most definitely a crime! the intent is always malicious if u know and ur partner doesn't. right to privacy does not extend to u not telling ur partner(s) that u r hiv pos.

1st or 2nd degree murder I think.
