If a hiv person dug their fingernail into someone who isn't hiv positive, can the hiv person be infected, there wasnt any blood

That's doubtful! I can't say impossible, but certainly not likely!
There wasn't any blood, and if there wasn't any sex either, I wouldn't worry about the fingernail. You don't get HIV that easily! You can get it easily through the use of needles that others have used (that has contact with their blood). You can get it easily by having sex with an Hiv infected person. Tests may not reveal that for years to come, so always use condoms!
