When an HIV Positive man has sex with a woman, without telling her, he can be charged with assault.?

Shouldn't the women, who had sex with him, without using protection, also be charged with something, as they were also spreading the disease because of their choices of behavior. They wouldn't have been exposed had they used protection, or refused to have sex without it. We only blame the men, but isn't anyone not using protection as much at fault?

Of note, when a woman is HIV positive, she is not charged with anything, not even as a pedophile, as was the case of a woman with five young boys in Missouri.

They should actually be charged with attempted murder. And as far as only blaming men, you must undestand that this is what's fashionable, and our legal system is now set up under Feminist Jurisprudence, where women are presumed to not have any criminal or dishonesty genes, while at the same time men are presumed to be guilty until proven innocent regarding anything.

you could look at it this way, but if he did not give all the information he was not giving the option. If you had sex with some one but they told you first, would you not bother? that would be like someone not telling you before they shot you in the face.

Yeah he can be charged but its more like attempted murder. Yeah you can blame a woman for making a bad choice for not using protection but its not like she's just willfully spreading the disease cause she probably don't know she got it and using protection now doesn't stop you from getting HIV or a STD, check you sources

No just the man. Because if he is aware of his condition and does not notify her the onus was really on him. So few people have HIV as a percentage of the overall population you can't really blame the woman in this case.

Also this only applies in most states. Some states still, unfortunately, do not have laws against the knowingly malicious spread of HIV.

If the woman similarly knows she is positive and does not notify her partner, she can be charged as well. Basically these people should be put to death.

He can be charged assualt?, I don't think so. It's highly unlikely that the woman would get HIV through vaginal sex with an infected man, but aside from that. She should have the responsibility to protect herself by practicing safe sex.

Well from one standpoint I would say anyone who has unprotected sex has to realize they could possibly be contracting a disease, possibly life-threatening. Only you are responsible for your own actions. Morally, how can you do that to someone - knowingly sleep with them, not use protection, completely disregarding their health? To me, the one carrying the disease has a moral obligation to protect others. But stopping the spread of AIDS takes cooperation on everyones part, not just the guys, not just the ladies.

Here in VA there was a recent case of a man who knowingly infected a young woman with AIDS. He wasn't charged with attempted murder, it was a misdemeanor, something like "purposefully transmitting an infectious disease", although he admitted knowing he could pass it to her and commented "Sometimes life is like that." That is a careless disregard for human life if you ask me, just like shooting a gun into a crowd.
