If a gay co-worker is HIV positive and he doesn't tell his "hook-ups" is it a crime?


And am I liable for knowing?

He's very good looking, muscular and buff. Looks like a work-out model and is asymptomatic (no visible symptoms of HIV infection, unless he's ill with respiratory stuff, about every four months). I've seen his meds in his desk drawer and I know they're for treating HIV. After work he goes out to a gay bar and hooks up with other guys (he brags about his conquests, that's how I know) and I doubt he tells them his HIV poz status. Is it the law for him to tell partners he's infected? I kind of touched on it with him and he said, "I play safe and anyway, anybody who goes home with me knows the risks, and they're adults capable of making their own choices".

But does he give them the choice? And is what he's doing illegal?

Okay, none of the answers so far are very helpful, I'm asking a LEGAL QUESTION. It's about what the law dictates not your opinions, or 'I think". I only want hard facts as dictated by the law and what the specific law is. I would prefer answers only from people actually in the law profession.
So.....

1)Nobody's been murdered at this point.
2) Yes, he's a jackass, but that's not against the law.
3) I'm not interested in the ethical part, just the legal part. Is there a specific law that forbids HIV positive people from not disclosing their status to partners?

Depends on your jusirtiction.

In Victoria, Australia, it is definetely illegal and a number of HIV positive people have been charged after not disclosing their status. Most have been convicted.

It's illegal, for obvious reasons. And if he wouldn't tell his "hook-ups" he's a jackass.

pretty sure it is against the law. That is how a friend of mine found out his wife was cheating on him the Hostpital called him and told him he had an STD. It help get his kid in court also.

Who cares? The people that sleep with him know there is some kind of risk whether he tells them or not. They have the choice to not sleep with everybody they meet.

What he is doing is definitely unethical if not illegal. At the very least he's being safe, but he really should be honest with his partners.

unless you know for sure hes not informing them i would keep quiet - you open yourself up to ruin that way

It's a gray area of law,some states require you to disclose your HIV status.
If he is not telling his "hook-ups" and not practicing "safe sex" or even if he practices safe sex and his hook-up contracts aids from him,your co-worker could be charged with murder and sent to prison even though no one has died yet.

It is illegal. He can go to prison. If someone doesn't murder him first.

Well, if he's positive and tells them that he's not and goes bareback then it's a crime, he's been infecting others intentionally. Well atleast in here infecting others with a deadly virus with no cure for it is a crime...

You dont have to tell anyone your sexpartners of course, but you cant go saying that you're clean if you're not!
