I told my Doctor I wanted an HIV test done?


Did my doctor do something illegal?
Sometime in November of 08 I had asked my Doctor for an HIV/STD test so he took blood from me. I waited about almost a week then I called and he gave me the results(Test came back Negative for everything). In about May 09 I switched doctors and She(Doctor) had ask me to call my old doctor and tell them to send her the results from when I had taken my Blood Sugar Test, Cholesterol levels etc, however*** they did NOT send her the HIV test results. Now does my old Doctor keep it discrete unless my new Doctor asked for them??? Im freaked out again because my NEW doctor told me she didnt get any HIV test results from them?? Im so freaked out again because i have to get another HIV test( I havent had sex since though) BUT i want to make sure my DOC took an HIV test because I dont remember signing any piece of paper (I live in NY) If my Doc told me the test came up Negative and he dosent have documents to prove it, im going to sue. BUT PLEASE I NEED SOME INFO PEOPLE THANK YOU

No, your doctor did not do anything illegal. Most likely, your new doctor did not request the test results, and without a signed request from you and your new doctor specifying that HIV test result, your old doctor is forbidden by law from giving it out. It's that old patient confidentiality thing at work. However, you would still need to take a second HIV test because those results are more than six months old now. Although you say you haven't had sex in the meantime, I assume you had sex prior to the test. If you had sex within six weeks of that first test, you may have been exposed but not had time to form antibodies. Since it has now been more than six months, you would show positive now. You do not have to sign anything to get an HIV test done. You have to sign things if it is positive, or if you wish the doctor to release the results of that test to another doctor. You must specify each and every single thing you wish disclosed, or the old doctor can't give it out. It sounds like he actually abided by the law ,rather than broke it.
