They cannot collect information on you (including HIV) unless you give them permission. The HIV consent is usually in the medical authorization, if you signed one. Sometimes it is a separate form. Ask the agent and read what you sign and you'll know.

If you do not give them permission to collect the information, they do not have an obligation to offer you coverage without that information and will almost always turn you down. If you recently had an exam for life insurance and want to know your results, you can usually contact the company and ask for a copy of your lab results.

It depends on the company, but you have to disclose any preexisting conditions to them and any stays in the hospital and a bunch of other things in an oral interview and then a lot of them also do blood tests prior to enrolling new patients. Life insurance companies do all the same plus a urine test. If you have HIV or even full blown AIDS it will be hard to hide from an insurance carrier. There are companies that will cover you but hiding something this large will just get your policy canceled if you get one.

there is a clause in the contract which requires you to disclose ALL existing medical conditions, plus every doctor you've seen for the past N years, and then the underwriter at the company will write an exclusion for each of them for at least the next three years. Such exclusions do not expire automatically, but only if you've had NO (zip, zero, none at all) medical expenses related to that condition for the whole time you've been a customer.

if you lie about it and they figure it out, they'll not only deny coverage, but they'll sue you for any amounts they've paid out in excess of the premiums received, AND refer you to the local DA for insurance fraud.


figuring out HIV/AIDS isn't very difficult -- the computers already know what the usual treatments are and have been programmed to refer any such bills for manual inspection. Then the company's medical reviewer faxes a copy of your signed medical records release form (required to even get insurance) to the doctors involved and calls them about your medical history.

if the doctor tells them you've apparently had HIV for years and you've only been a customer for months -- reject!.

the medical records person also asks your present doctors about any past doctors they know you've seen and then checks both with them and your disclosure of past medical history for omissions.

of course, the DA is no dummy either. He knows that someone with HIV is a big drain on the prison system and may well refuse to prosecute, or decide to only ask the Judge for a whopping fine but no jail.
