HIV Test by blood.?

I am wandering when doctor feel someone need HIV test by blood, if they can send blood to lab for HIV test without telling to their patient.
or they must to get permittion from their patient. The doctor I go, they just give me the paper work and send me to Lab, so I have a chance to read what kind of test I am getting for. However, some doctor take blood at their facility and send to lab and you do not have a chance to know what kind of test you are getting for.
I am wandering how it wark ?
If doctor want to send blood for HIV test, how test description or test code look like on the paper?

Actually this is suppose to be the one test that they must ask for permission to test for before you take it (including a signature), but things could change depeding on the state that you live in and the Bush administration. In Oregon they need your permisson and need to tell you that this test is being performed. There should be no reason that you need to get the test taken at a separate lab since there is such a high level of confidentiality concerning HIV in the US.
I have heard of a case where an insurance company had performed the test without the person knowing, but I find this highly suspicious.
If you have concerns about your HIV status then I would suggest asking for an HIV Rapid Test which takes only an hour for the entire test including the counsiling, but this test is only considered preliminary and a positive test result must be followed by a larger test such as the HIV Oral Test or Serum test. Oral is easiest.
NOTE: THE INFORMATION IN THIS IS BASED ON HIV TESTING PRACTICES IN THE STATE OF OREGON AND CAN NOT NECESARALLY BE APPLIED TO ALL STATES.

I think the doctor usually has to ask the patient, but personally I feel they shouldn't have to! They dont ask permission to test for any other disease so why HIV;

That is a very good question. In fact it is an issue which is causing great debate in the HIV medical care community. In September 2006 the CDC recommended that voluntary HIV testing be a part of routine medical care.

To answer your specific question you would need to check with the department of health of your specific state. For instance I live in Pennsylvania and "Pennsylvania鈥檚 Confidentiality of HIV-Related Information Act, commonly known as Act 148, (35 P.S. 搂7601, et seq) requires both the informed written consent of the patient and pre-test counseling before an HIV test is performed. These provisions of Pennsylvania law are safeguards to ensure that HIV testing is done voluntarily and with the patient鈥檚 full knowledge of the meaning of a positive or negative test result."

The PA law is pretty standard practice as far as I am aware of most other states and countries have similar laws.

You can look at this website for the full text of the CDC recommendation:
