Will you hire somebody knowing he's HIV positive? |
I know this is a very sensitive subject. and I only am seeking HONEST opinion. If you are somebody like to "talk big", and pretend to be somebody you are not, please do not answer this question. Since my fiance has not officially hire the person yet, will his company receive a discrimination law suit if he decides not hiring the person? My HONEST opinion??? I would NOT hire that person! I feel sorry for him to some extent, but handling food? No way! Let's put it like this, I would not let him handle the food I eat, so therefore I could not let him handle the food I sell either. Too much risk there, in my opinion. If he hired someone else who is better qualified, than no, there is no discrimination. If he did NOT hire that person because they have HIV, and it is proven not to be a health risk/threat, than they open themselves up for a law suit. How he found out the individual was HIV positive might open someone else up to a law suit if they shared confidential information. i don't think by law he has to hire him.. he must do what is best for business. the thing is HIV can be passed down through the blood..handling meat.. let say he cuts him self and a small drop of blood gets on the meat..you could ask the FDA what the rules are for hiring people with HIV.. they may not even allow it.. who knows.. no, insurance would go real high and he would be missing a lot of work. Sorry but I got to make sure I take care of everybody in my business. A lot of people lively hoods depend on there jobs at my business. MY HONEST opinion? No! Don't hire him. I know he needs a job too, but not in the food industry gross! You worried about a lawsuit? Wait til people find out that your husband has a HIV positive person handling their food! Dont hire him!!!! Yes I would hire him. Food compaines/stores don't reveal what all touches the food before being sold to customers. And I'd rather not know. Food has not killed me yet. no I would not hire him & he can not sue the company just b/c he didnt get hired! I would first suggest that you mention to your fiance AND his partner that they need to make an informed decision. Not one based on fear and fear alone. They could call the county Health Depatment, CDC physicians etc and ask them what the actual harm to the general public would be should they hire this individual. And if this person is qualified and his HIV status was the only reason he wasn't hired he could bring a lawsuit against your fiances company. That being said it would be extremely difficult to prove. I hope that this helps. Try reposting this in the "Businesses" or the "Law & Ethics" sections. |
