We were given a 60 day notice to vacate even though our rent has NEVER been late, nor are we even remotely considered problem tenants. My nephew who is disabled d/t HIV diagnosis and I, his aunt/caregiver are the current tenants. My nephew has lived here for approx. 5yrs and myself for almost 2 yrs. We have a restraining order against another tenant d/t his physical/verbal abuse against my nephew & had been in effect since 7/95. New mgrs seem to want to show favoritism towards this other tenant d/t his assistance around the complex with yardwork, etc!! We are unable to even remotely be able to afford to move, let alone find another apt this nice for this amount of rent. HELP us with legal advice or who to go to for this. PLEASE!!! DS

I think you might have a case on the grounds of discrimination based on health status. California law specifically prohibits discrimination on the basis of HIV/AIDS infection. Contact the LA County Housing Dept., or Fair Housing Commission. You don't need a lawyer for this. Lodge a complaint against the landlord, and the agency will investigate it for you.

You could also file a motion to dismiss or at least postpone the vacate notice on the grounds that a discrimination investigation is underway. This is not a big deal. Go to the LA County Superior Court web site, and go to the Forms link. There are a number of forms to use for filing a motion. I believe it costs $100 to file the motion.

You should also respond to the notice, indicating your intention of filing a complaint with the Fair Housing Commission.
